"NO MONEY" FOR BLACK MOLD? HAZARD CLAIMS SPREAD THROUGHOUT COURTHOUSE PLAZA

BEDFORD, IN — What began as testimony during ongoing Lawrence County Council budget hearings has escalated into broader concerns regarding health conditions inside county-owned facilities.

During public budget presentations, the Lawrence County Prosecutor disclosed to council members that the Prosecutor’s Office is dealing with black mold throughout its workspace. The situation gained further complexity when testimony revealed department heads keep being told there is "no money" available to remediate the environmental hazard.

Now, additional confirmation indicates the Lawrence County Public Defender’s Office is experiencing mold issues within its space as well.

A Systemic Issue Beneath the Courts

The environmental concerns are centered on the basement level of the Courthouse Plaza complex. The multi-department building acts as a hub for the local criminal justice system, housing:

• Superior Court 1 & Superior Court 2
• Lawrence County Prosecutor’s Office
• Lawrence County Public Defender’s Office
• Lawrence County Probation Department
• Community Corrections

Because basement environments are particularly susceptible to moisture, humidity retention, and HVAC drainage problems, shared air handling systems can elevate localized mold issues into facility-wide air quality challenges.

Having both prosecuting attorneys and public defense counsel working under compromised environmental conditions creates an unprecedented alignment across adversarial sides of the local justice system. Hundreds of county employees, probation officers, attorneys, defendants, and citizens attending daily court proceedings pass through the complex weekly.

Funding vs. Legal Obligations

While budget constraints are a central focus during annual council hearings, Indiana law places explicit statutory responsibility on the Lawrence County Commissioners to maintain safe and usable public county facilities.

Local governments maintain specific fiscal tools for building upkeep, including Cumulative Capital Development (CCD) funds, emergency additional appropriations, and capital improvement reserves. Unaddressed mold issues in active workplaces expose local government to potential worker's compensation claims, Indiana Occupational Safety and Health Administration (IOSHA) complaints, and judicial operational delays.

Public records requests under the Indiana Access to Public Records Act (APRA) are being prepared to review previous air quality assessments, facility inspection logs, maintenance work orders, and capital improvement funding requests for the Courthouse Plaza.

Indiana Code § 36-2-2-24 (County Courthouse & Public Offices): Grants the County Executive (the Board of County Commissioners) explicit statutory authority to establish, repair, alter, and maintain county buildings, courthouses, and public offices.
